1. Acceptance of Terms
By accessing or using NeighborLens ("Service"), operated by NeighborLens LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
You must be at least 18 years of age and a resident of the United States to use this Service. By using the Service, you represent that you meet these eligibility requirements.
These Terms incorporate our Privacy Policy and Disclaimer by reference.
2. Important FCRA Disclaimer & Permissible Use Restrictions
NEIGHBORLENS IS NOT A CONSUMER REPORTING AGENCY AS DEFINED BY THE FAIR CREDIT REPORTING ACT ("FCRA"), 15 U.S.C. § 1681 ET SEQ. THE REPORTS PROVIDED BY NEIGHBORLENS ARE NOT "CONSUMER REPORTS" AS DEFINED BY THE FCRA.
NeighborLens provides neighborhood-level research and area intelligence reports. Our reports are designed to help homebuyers evaluate neighborhoods and surrounding areas, not to evaluate specific individuals.
You may NOT use NeighborLens reports for any of the following purposes:
- Evaluating any individual for employment or hiring decisions
- Tenant screening or making housing eligibility decisions about any individual
- Determining any individual's creditworthiness or eligibility for credit
- Making insurance underwriting decisions about any individual
- Any other purpose governed by the FCRA
- Any purpose that would constitute a "background check" on a specific person
By using the Service, you certify that you will not use any NeighborLens report for any FCRA-regulated purpose. Violation of this restriction will result in immediate account termination and may subject you to legal liability.
3. Service Description
NeighborLens provides neighborhood due diligence reports that aggregate publicly available data and licensed third-party data for the purpose of helping homebuyers research and evaluate areas they are considering. Reports may include crime statistics, sex offender registry information, property records, environmental data, noise indicators, insurance requirements, utility costs, demographics, court records, code enforcement history, news, business activity, and other area-level data.
Reports are reviewed by human analysts before delivery. Some portions of reports are generated or synthesized using artificial intelligence. We reserve the right to modify, update, or discontinue any data categories or features at any time.
4. AI-Generated Content Disclosure
Portions of NeighborLens reports are generated, synthesized, or summarized using artificial intelligence and large language models. While AI-generated content is reviewed by human analysts, it may contain errors, inaccuracies, or misinterpretations.
AI-generated analysis should not be treated as professional advice of any kind, including legal, financial, environmental, or real estate advice. You should independently verify any information that is material to your decisions.
5. Data Accuracy & "As-Is" Disclaimer
Reports are provided "AS IS" and "AS AVAILABLE." Data is sourced from public records, government databases, and third-party providers believed to be reliable, but we do not guarantee the accuracy, completeness, or timeliness of any information.
Data may be outdated, incomplete, or contain errors from upstream sources. Crime statistics, environmental data, property values, and other information are point-in-time snapshots and may not reflect current conditions. Information in our reports should not be the sole basis for any real estate, financial, or personal decision.
NeighborLens reports are generated using publicly available data from federal, state, and municipal sources. The depth, recency, and granularity of data varies by geographic location and is dependent on what each jurisdiction makes publicly available. Reports for areas with limited public data coverage may contain less granular information than reports for areas with extensive open data programs. NeighborLens does not guarantee uniform data coverage across all locations and makes no warranty regarding the completeness or accuracy of third-party data sources.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6. Prohibited Uses
In addition to the FCRA restrictions above, you agree NOT to:
- Use reports for discriminatory purposes in violation of the Fair Housing Act (42 U.S.C. § 3601 et seq.)
- Use reports or any data therein to stalk, harass, or intimidate any individual
- Use reports for any illegal purpose
- Redistribute, resell, or sublicense reports or their contents
- Use automated tools to scrape, crawl, or bulk-download data from the Service
- Reverse-engineer our data sources, methodologies, or scoring algorithms
- Use reports as a substitute for professional legal, environmental, real estate appraisal, or insurance advice
- Misrepresent your identity or provide false account information
7. User Accounts
To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the security of your credentials and for all activity that occurs under your account. You must notify us immediately at support@neighborlens.com if you become aware of any unauthorized access to your account.
We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice.
8. Payments, Pricing & Refund Policy
All payments are processed securely through Stripe. We do not store your credit card information. Prices are listed in U.S. dollars and are subject to change with notice. Payment is charged at the time of order.
Refund Policy:
- Full refund: If we are unable to generate a report for your address due to insufficient data availability, you will receive a full refund.
- Satisfaction-based refund: If you believe your completed report contains material deficiencies, you may request a refund within 14 days of delivery. Refund requests are evaluated on a case-by-case basis.
- No refund: Reports that have been delivered and accessed are generally considered final. We do not offer refunds for dissatisfaction with publicly available data or neighborhood conditions revealed in the report.
To request a refund, contact support@neighborlens.com with your order number and reason for the request.
9. Intellectual Property
NeighborLens and its licensors own all intellectual property rights in the Service, including the platform, report format, analysis methodology, scoring systems, and branding. Upon purchase, you receive a limited, non-exclusive, non-transferable license to use your report for personal or internal business use only.
Reports may not be reproduced, distributed, or publicly displayed without our prior written permission. Third-party data providers retain their respective intellectual property rights.
10. Third-Party Data Sources
Reports incorporate data from third-party sources including government databases, public records, and licensed data providers. We are not responsible for the accuracy, availability, or completeness of third-party data. Third-party services may become unavailable at any time, which may affect report content.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEIGHBORLENS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC REPORT GIVING RISE TO THE CLAIM.
Without limiting the foregoing, we are not liable for any decisions you make based on report data, including real estate transactions, property purchases, or relocation decisions. We are not liable for inaccuracies in third-party data, AI-generated content errors, or the actions of any individuals identified or not identified in reports.
12. Indemnification
You agree to indemnify, defend, and hold harmless NeighborLens and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms; (b) your misuse of report data; (c) your violation of the FCRA, Fair Housing Act, or any other applicable law; or (d) any third-party claim resulting from your use of reports.
13. Dispute Resolution & Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court.
CLASS ACTION WAIVER: YOU AND NEIGHBORLENS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within its jurisdictional limits. You may opt out of this arbitration provision by sending written notice to legal@neighborlens.com within 30 days of creating your account.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any court proceedings (where permitted) shall be brought exclusively in the state or federal courts located in New Jersey.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
16. Termination
We may terminate or suspend your account at any time for violation of these Terms. You may terminate your account by contacting us. Upon termination, your right to access the Service ceases, though previously purchased and delivered reports remain accessible for 90 days. Sections 2, 5, 6, 9, 11, 12, 13, and 14 survive termination.
17. General Provisions
These Terms constitute the entire agreement between you and NeighborLens regarding the Service. If any provision is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of that provision. We may assign these Terms; you may not. Nothing in these Terms creates a partnership, joint venture, or agency relationship.
